These Terms and Conditions (“Terms”) govern your access to and use of SANJAY DRISHTI App. By downloading, installing, registering for, accessing, or using the App, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms. If you do not agree to these Terms, you must immediately discontinue use of the App.
The App provides workforce management, employee attendance, location tracking, communication, reporting, analytics, and related technology-based services intended solely for lawful, authorized, and legitimate business or operational purposes and also for personal purpose (in case app is being used by family member/relative/loved one for ensuring safety and security of other family member/relative/loved one).
By using the App, you represent and warrant that you are legally authorized to install and use the App and that you have obtained all necessary permissions, authorizations, and informed consents from any individual whose device, location, activity, or information may be monitored, tracked, processed, or accessed through the App.
Users acknowledge and agree that the App may collect and process personal data like name, mobile number, email, photos, location information, attendance data, work-activity records, and related operational information during official working hours or as per the time period consent given by users, where reasonably necessary, during limited periods outside working hours for business continuity, operational synchronization, compliance, or emergency purposes and for safety and security of family members/relative/loved one.
Where tracking or monitoring is required as part of employment, field operations, attendance management, or workforce supervision, users acknowledge that such monitoring may constitute a necessary operational requirement for specific assignments or organizational functions and/or for ensuring personal safety and security.
Users shall not use the App for unlawful surveillance, unauthorized tracking, harassment, stalking, spying, identity theft, invasion of privacy, child exploitation, fraudulent conduct, criminal activities, or any activity prohibited under applicable local, national, or international laws.
Users further agree not to misuse collected information, interfere with App functionality, attempt unauthorized access, manipulate location data, or engage in activities that may compromise privacy, security, or legal compliance.
Users are solely responsible for all activities conducted through the App and for ensuring compliance with applicable privacy laws, employment regulations, surveillance laws, telecommunications regulations, and data protection requirements within their jurisdiction.
Users are responsible for obtaining legally valid consent wherever monitoring or tracking of another individual is involved. The App does not independently verify whether such consent has been obtained.
The App functions solely as a technology platform. The developer of the App shall not be responsible for disputes arising between employers and employees, family members, relatives, loved one, spouses, parents, business associates, contractors, or third parties relating to the use of the App, monitored information, attendance records, location data, workplace supervision, employment decisions, or personal relationships. User agrees to use this App on self’s discretion and risk & cost.
To the fullest extent permitted under applicable law, the App and related services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied. The App does not guarantee uninterrupted operation, continuous availability, precise GPS accuracy, real-time tracking accuracy, or error-free functionality.
The App/developer of App shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to the use or misuse of the App, including inaccurate location information, unauthorized monitoring, service interruptions, privacy claims, employment disputes, device failures, data loss, third-party conduct, or legal proceedings.
To the maximum extent permitted by law, the total liability of the App under any claim shall not exceed the amount paid by the User for the App during the preceding twelve months or INR 500, whichever is lower, subject to outcome of legal proceedings.
You agree to indemnify, defend, and hold harmless “Sanjay Drishti” App, its directors, officers, employees, affiliates, contractors, licensors, partners, and service providers from and against any claims, liabilities, damages, penalties, proceedings, investigations, losses, or expenses arising from your use or misuse of the App, violation of these Terms, unlawful monitoring activities, privacy violations, breach of applicable laws, or infringement of third-party rights.
The App may integrate with or depend upon third-party platforms and services including mapping APIs, cloud hosting providers, analytics providers, advertising networks, and services provided by Google or other third-party vendors. The App shall not be responsible for third-party outages, policies, security incidents, or external service disruptions. Personal data shall be shared with third parties like payment gateway, cloud provider, SMS provider, analytics tools, etc.
We reserve the right to suspend, restrict, or terminate access to the App without prior notice where we reasonably believe that a User has violated these Terms, engaged in unlawful conduct, misused the App, infringed third-party rights, or created operational, legal, or security risks.
These Terms shall be governed by and interpreted in accordance with the laws of India. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts located in District Auraiya, Uttar Pradesh, India.
We reserve the right to revise or modify these Terms at any time. Updated versions will be published through the App or official website. Continued use of the App following such modifications constitutes acceptance of the revised Terms.
